A 35 year-old man, Sambo Soliu, was on Friday, arraigned before an Ebute-metta Chief Magistrate’s Court, Lagos, for attempting to kill his live-in partner, Amusalat Busayo Agbaje, age 24.
The defendant, a native of Ilorin, the Kwara state capital, was alleged to have committed the offence on December 29, 2015, at his residence situated at Oshun Estate, Araromi, along Badagry Expressway.
He was alleged to have attempted to kill the woman by slitting her throat with a kitchen knife during a misunderstanding that ensured between them.
The charge against the defendant reads: “that you Sambo Soliu on 29 December, 2015, at about 0600 Pm, at Oshun Estate, Araromi, along Badagry Expressway, Lagos, in the Lagos Magisterial district did attempt to kill one Amusalat Busayo Agbaje, age 24 years, by slaughtering her throat with a kitchen knife and thereby committed an offence punishable under Section 228 of the Criminal laws of Lagos state, 2011.”
However, the defendant pleaded not guilty to the charge.
Upon the plea of the defendants, his lawyer, Spurgeon Ataene, urged the court to admit him bail in the most liberal term. He said the request for the defendant’s bail application was pursuant to section 264 (2) of the Administration of Criminal Justice of Lagos state, 2011.
Spurgeon also informed the court the victim has signified her intention to withdraw the matter.
However, the prosecutor, Sergeant Jimah Iseghele did not opposed the bail application.
Ruling on the bail application, the presiding magistrate, B. O. Ope-Agbe, admitted him to bail in the sum of N2 million with two sureties in the same like sum.
Magistrate Ope-Agbe also ordered that the sureties must show to court evidence of three years tax payable to the Lagos State government, and sworn to affidavit of means, and have their verified by the court prosecutor.
She also ordered that the case file be duplicated and forward it to the office of Directorate of Public Prosecution, DPP, for advice.
The matter has been adjourned till April 27, for DPP’s advice.
